SHORT-TERM RENTAL REGULATIONS BINDING FROM 02/08/2021


  1. General
1.1. These Regulations define the terms of reservation and short-term rental service of premises available in the BillBerry Apartments offer and constitute an integral part of the short-term apartment rental agreement concluded between the Customer and BillBerry Apartments, a template of which is attached to the Regulations. As part of the short-term apartment rental agreement, BillBerry Apartments undertakes to provide the Customer with the Apartment, and the Customer to pay the remuneration and comply with the rules set out in the Agreement and these Regulations.

1.2. Before making a reservation, the Customer is obliged to read the content of the Regulations. By making a reservation, you accept its content.

1.3. BillBerry Apartments declares that it has a legal title to the Apartment, which is the subject of the contract concluded with the Customer, and is entitled to provide the service of temporary provision of the Apartment for tourist or leisure purposes.

1.4. BillBerry Apartments informs customers that pursuant to art. 38 point 12 of the Act of May 30, 2014. on consumer rights, in the case of a contract for the provision of accommodation services other than for residential purposes, the consumer is not entitled to withdraw from the distance contract, which the Customer hereby acknowledges .

  1. Definitions
2.1.  Apartment a flat offered by BillBerry Apartments, described in detail on the website www.billberry-apartments.pl or other intermediary portals, being the subject of the reservation or the Agreement;

2.2. BillBerry Apartments - BillBerry Capital Group S.A. with headquarters in Gdańsk (80-017), at ul. Trakt Święty Wojciecha 149, entered into the Register of Entrepreneurs of the National Court Register by the District Court Gdańsk-Północ in Gdańsk, 7th Commercial Division of the National Court Register under the number: 0000716777, NIP: 5842767963, REGON: 369471268, share capital: PLN 100,000.00, in fully paid up;

2.3. Client - a natural or legal person who is a party to a short-term rental agreement for an apartment or expressing a willingness to use the services of BillBerry Apartments.

2.4. Regulations - these Short-term rental Regulations;

2.5. Resident - a person designated by BillBerry Apartments, who is authorized to release and collect the Apartment from the Customer, as well as to other activities specified in these Regulations;

2.6. Website - the website www.billberry-apartments.pl, through which the booking platform is made available;

2.7. Agreement - a short-term apartment rental agreement concluded between the Customer and BillBerry Apartments, the specimen of which is attached to the Regulations.

  1. Reservation
3.1. By making a reservation, you accept the content of the Regulations.

3.2. The apartment can be booked in the following way:

  • Using the booking form provided by BillBerry Apartments, via the website www.billberry-apartments.pl ;
  • Via the hotline at: + 48 572-090-800 available only from Monday to Friday, 9.00-17.00;
  • To the e-mail address: rezerwacje@billberry-apartments.pl;
  • In person at the BillBerry Apartments office located in Sopot, Aleja Niepodległości 709/2, open from 9:00 a.m. to 5:00 p.m. from Monday to Friday;
  • Via an intermediary portal cooperating with BillBerry Apartments.

3.3. During the booking process, the Customer is obliged to provide the following information:

  • Date of stay (check-in and check-out date);
  • Selected Apartment;
  • Contact details (name, surname, telephone number, address);
  • The number of people in the Apartment, with the proviso that it cannot exceed the permissible number of people indicated in the offer;
  • Scheduled time of arrival;
  • Additional services;
3.4. Confirmation of the reservation by BillBerry Apartments takes place by delivery to the e-mail address provided by the Customer during the booking process, a message with information about the confirmation of the reservation, summary of the offer and determination of the total price of the service.

3.5. A stay of a child up to 6 years of age, sleeping with a guardian or in their own private cot, for which no additional bedding is required, is free of charge. There may be one child up to 6 years of age per guardian, whose stay is free of charge. At the time of booking, please provide the total number of people along with the age of the children and separately for children whose stay is considered free (this information should be added in the NOTES tab).

  1. Reservation fee
4.1. Within two working days from the date of receipt of the booking confirmation referred to in point 3.4, the Customer is obliged to pay the booking fee by bank transfer or online payment method, in the amount of 30% of the total price of the service indicated in the booking confirmation. Failure to pay the reservation fee is tantamount to canceling the reservation, without the need to set an additional date for payment.

4.2. Unless the parties agree otherwise, the Customer is obliged to pay the total price of the service (less the booking fee), no later than on the day of check-in, in the form of cash, payment by credit card or via the DotPay system.

4.3. If the booking fee is paid by bank transfer, BillBerry Apartments may require the Customer to present a confirmation of the transfer directly before the planned date of arrival.

  1. Change / cancel reservation
5.1. Changing the reservation is possible only when the Apartment has not been booked on another date selected by the Customer. If the price of the service on the new date is higher than the current one, the Customer is obliged to cover the difference in the price of the service. Changing the reservation is possible up to 14 days before the planned arrival.

5.2. Cancellation of the reservation is possible up to 30 days before the planned arrival. In this case, the paid reservation fee will be returned within 7 working days to the indicated bank account number. In case of canceling the reservation after the indicated date, the reservation fee will not be refunded.

5.3. In the event of force majeure, i.e. extraordinary circumstances beyond the control of either party, natural disasters, strikes, warfare or other exceptional situations preventing the service from being provided, BillBerry Apartments has the right to withdraw from the concluded Agreement with the obligation to return all amounts paid by the Customer to the indicated account banking.

5.4. If there are unforeseeable circumstances in the Apartment booked by the Customer, the effects of which cannot be removed, BillBerry Apartments will offer the Customer a replacement apartment of a similar standard. In this case, the Customer has the right to withdraw from the concluded Agreement with the obligation to return all amounts paid by the Customer to the indicated bank account.

  1. Check in and check out
6.1. The hotel day starts at 4:00 p.m. on the check-in day and ends at 11:00 a.m. on the check-out day. The customer is obliged to inform BillBerry Apartments at the latest one day before arrival, about the planned time of picking up the keys to the Apartment and at the latest one day before check-out, about the planned time of leaving the Apartment and returning the keys. During check-out, the keys are collected by the Resident directly in the Apartment.

6.2. Check-in takes place from 16:00 to 21:00, directly at the BillBerry Apartments office, located at Al. Niepodległości 709/2, 81-853 Sopot, tel. +48 572 090 800 or at the place and time indicated by the BillBerry Apartments employee. In the case of check-in after 21:00, the Resident hands over the keys to the indicated apartment for which the reservation has been made. Late check-in is subject to an additional fee, payable in cash on arrival:

  • Between 21:00 and 00:00, amounting to 100 (say: one hundred) zlotys;
  • Between 00:00 and 4:00, amounting to PLN 150 (in words: one hundred and fifty zlotys). In order to confirm the possibility of check-in before 16:00 and after 21:00, prior contact with BillBerry Apartments office is required.
6.3. In the case of checking out before 7:00, an additional fee of PLN 100 (in words: one hundred) will be charged.

6.4. In the event of a delay in arriving at the agreed time, the Customer is obliged to immediately notify BillBerry Apartments by phone. If there is no contact with the customer, the reservation may be canceled.

6.5. During check-in, the Customer is obliged to present an identity card with a photo and provide the payment card number. Which it is the owner of and its expiry date along with the CCV number. In the absence of a payment card, a security deposit is charged in the amount of PLN 500 (say: five hundred) to PLN 2,000 (say: two thousand). The amount of the deposit may vary depending on the nature of the stay (a higher amount may be charged for special events and holidays) and the number of people. The deposit is returned upon check-out. Data from the payment card or the deposit is a security for claims for damages. The collection and return of the keys can only be done by an adult person making the reservation. Deduction of receivables from BillBerry Apartments from the deposit does not exclude the pursuit of claims for damages, the value of which exceeds the collected deposit.

6.6. BillBerry Apartments reserves the right not to hand over the keys to the Apartment to persons under the influence of alcohol, intoxicants, behaving aggressively and posing a direct threat to other people and property or persons without a photo ID on the day of check-in. BillBerry Apartments may refuse to accept customers who have grossly violated the Agreement or the Regulations during their previous stay, including in the event of unpaid payments.

6.7. Before checking out, BillBerry Apartments reserves the right to check the technical condition of the Apartment. In the event of damage caused during the stay, the Customer is obliged to cover the cost of the repair in full, no later than on the day of check-out.

6.8. Early departure for reasons beyond the control of BillBerry Apartments does not entitle you to claim reimbursement for unused services.

  1. The client's obligations during the stay in the apartment
7.1. The Customer undertakes to use the Apartment only for tourist or leisure purposes and may not sublet the apartment or use it free of charge to any third parties.

7.2. Immediately after checking in, the Customer should report any irregularities in the Apartment, otherwise it may result in the Customer being charged with the costs of repairing the damage found.

7.3. The apartment is quiet from 10 p.m. to 7 a.m. In the event of non-compliance with generally accepted standards of social coexistence, disturbing the peace of neighbors, BillBerry Apartments reserves the right to immediately terminate the Agreement, without the obligation to refund the costs for the unused period of stay.

7.4. Organizing any kind of events in the Apartments is prohibited. In the event of breaking the ban on organizing events, the Lessor reserves the right to immediately terminate the Agreement, without the obligation to refund the costs for the unused time of stay.

7.5. Without the prior written consent of BillBerry Apartments, the Customer may not make publicly available, in particular on internet portals, photos or videos taken in the Apartment, which show its equipment.

7.6. The customer is obliged to maintain and return the apartment intact. On the day of departure, guests of the apartment are required to throw their rubbish into the bins located outside the building.

7.7. BillBerry Apartments or another designated person has the right to enter the Apartment to remove a failure or in the event of a reasonable suspicion that the Customer violates the provisions of the Regulations.

7.8. The customer is obliged to pay special attention to the proper operation of water valves and electrical devices. Due to the fire protection regulations, the Customer may not use any non-standard equipment powered by electricity, except for: a computer, a razor, a hair dryer.

7.9. BillBerry Apartments is not responsible for items left in the apartment. Possible return of found items is possible only at the customer's expense.

  1. Additional services
8.1 The customer may order additional services according to the following price list:
  • Extra bed (single camp bed) - PLN 80 / night *
  • Baby travel cot - PLN 60 one-time fee for the entire stay *
  • Transfer from the airport - price determined individually
  • Pets stay - PLN 50 / day, only in selected Apartments
  • Baby bath tub / potty / step for a baby - free of charge, available if possible *
  • A shower chair for a disabled person - free of charge, available if possible *
  • Bed linen and towels exchange service - price determined individually depending on the number of guests. The date and time of the service must be agreed no later than on the day of the service by 10:00 and confirmed with BillBerry Apartments
  • Apartment cleaning service - PLN 150, one-time service
  • Screens and beach loungers - free of charge, if possible *
* Limited number available, advance booking required and confirmation by BillBerry Apartments.

  1. Animal stay
9.1. Only in selected Apartments it is possible for pets to stay. The Apartment staff has the right to refuse to make it available to customers who took a pet with them without prior arrangement.

9.2. Dogs must be kept on a leash at all times. Booklet confirming current vaccinations required. A bed should be taken for the dog. Pets are not allowed on sofas, armchairs, etc.

9.3. An additional fee is charged for the stay of animals, in accordance with the price list of Additional Services.

9.4. The owner is obliged to clean up after his pet.

9.5. The customer is fully responsible for the stay of the animal and any damage caused by it, including in particular cleaning carpets, armchairs, sofas from hair or removing unpleasant odors.

9.6. If, on the day of check-out, the condition of the apartment makes it impossible for other people to stay, the customer will be fined twice the price per night of the apartment.

  1. Responsibility
10.1. BillBerry Apartments is not responsible for any inconvenience caused during the stay related to:
  • Construction or finishing works carried out on the premises where the Apartment is located and around it;
  • Discontinuation of utilities delivery for reasons beyond the control of BillBerry Apartments;
  • Noise from neighboring properties.
10.2. BillBerry Apartments is not responsible for the loss or damage of the vehicle left by the Customer in the garage belonging to the Apartment or on external parking spaces.

10.3. The customer is responsible for any damage caused by his actions resulting from the use of paid or free attractions that are located on the premises of the facility where the customer rents the apartment, such as sauna, tennis courts, fitness rooms, playgrounds, etc.

10.4. The customer is obliged to immediately report any damage caused by himself during the stay and immediately pay for the equivalent amount. The customer also bears full responsibility for damages caused by persons staying in the Apartment with their consent or knowledge. If the damage prevents further rental, the Customer is additionally financially responsible for each day excluded from rental, in the amount of PLN 300 / day.

10.5. In the event of contamination of the apartment with vomiting, the Customer is obliged, at the request of BillBerry Apartments, to cover the cost of cleaning carpets and other contaminated materials - in the amount of PLN 1,500.

10.6. Smoking cigarettes and other tobacco products in the Apartments and in staircases and in the garage, as well as the use of candles, is prohibited. Violation of the ban entitles BillBerry Apartments to impose a contractual penalty in the amount of PLN 500.

10.7. In the event of failure to return the Apartment after the end of the Agreement, the Customer is obliged to pay twice the current price for the Apartment, specified on the website www.billberry-apartments.pl , for each day after the end of the Agreement.

10.8. When checking out, the Customer is obliged to hand over all shared keys or entrance cards and remote controls. In the event of failure to return, the Customer shall pay a fee of PLN 350 (keys, entrance card) or PLN 200 (remote control), respectively.

10.9. The number of people in the apartment cannot exceed the number specified when booking. If the number of people is greater, the Customer will be charged an additional fee of PLN 200 (two hundred) for each additional person for each night. BillBerry Apartments reserves the right to refuse to provide the keys in the event of exceeding the permissible number of people in the Apartment.

  1. Complaints
11.1. In the event of irregularities, the Lessee has the right to submit a complaint within 14 days of their occurrence. Complaints should be sent in writing to the address of BillBerry Apartments or by e-mail to the address reklamacje@billberry-apartments.pl .

11.2. The complaint is considered within 30 business days of its receipt. The customer will be immediately notified of its consideration by registered mail or by e-mail, to the appropriate address indicated in the complaint.

11.3. BillBerry Apartments does not provide for the possibility of using out-of-court complaint handling methods. To pursue claims in court, the court competent for the seat of BillBerry Apartments is the District Court Gdańsk-Północ in Gdańsk, and the defendant should be BillBerry Capital Group S.A. based in Gdańsk. The consumer also has the right to ask for help from the Municipal or Poviat Consumer Ombudsman.

12.1. The BillBerry Apartments office, competent for check-in and check-out, as well as available for ongoing service during the term of the Agreement, is located at: Aleja Niepodległości 709/2, 81-853 Sopot .

12.3. The correspondence address is the seat of BillBerry Apartments, indicated in point 2.2. Of the Regulations and in the Agreement.

  1. Privacy Policy
13.1. The personal data administrator is BillBerry Capital Group S.A. with headquarters in Gdańsk (80-309), at al. Grunwaldzka 472, entered into the Register of Entrepreneurs of the National Court Register by the District Court Gdańsk-Północ in Gdańsk, 7th Commercial Division of the National Court Register under the number: 0000716777, NIP: 5842767963, REGON: 369471268.

13.2. Personal data is processed in order to implement the Agreement and the Regulations. Providing data is voluntary, but necessary to use BillBerry Apartments services. Personal data will be processed until the expiry of the limitation period for claims under the Agreement or the Regulations, and in the case of data collected on the basis of consent, until its cancellation.

13.3. The basis for the processing of personal data is:

  • Art. 6 sec. 1 lit. b GDPR - the necessity to process them for the performance and performance of the contract;
  • Art. 6 sec. 1 lit. f GDPR - legitimate interest of the administrator consisting in handling correspondence and marketing activities.
13.4. Customers have the right to access their data and the right to request their rectification, deletion or limitation of their processing. The customer has the right to object to the processing of personal data.

13.5. To the extent that the basis for the processing of personal data is the consent granted, the Customer has the right to withdraw the consent. Withdrawal of consent does not affect the lawfulness of the processing which was carried out on the basis of consent before its withdrawal. The data may be profiled within the scope of the consent granted.

13.6. Personal data may be transferred to companies providing accounting services.

13.7. In all matters relating to the processing of personal data and the exercise of rights related to data processing, you can contact the Administrator by post to the address of the Administrator's seat, indicated in point 12.1. or electronically to the following e-mail address: daneosobowe@billberry.pl . The customer has the right to lodge a complaint with the supervisory body dealing with the protection of personal data (the President of the Office for Personal Data Protection).
