SHORT-TERM RENTAL REGULATIONS APPLICABLE FROM November 29, 2022

  1. General

1.1. These Regulations define the conditions for booking and short-term rental services of the premises available in the BillBerry Apartments offer. As part of the short-term apartment rental service, BillBerry Apartments undertakes to provide the Customer with the Apartment, and the Customer undertakes to pay remuneration and comply with the rules set out in these Regulations.

1.2. Before making a reservation, the Customer is obliged to read the Regulations. Making a reservation is tantamount to accepting its content.

1.3. BillBerry Apartments declares that it has a legal title to the Apartment, which is the subject of the contract concluded with the Customer, and is entitled to provide the service of temporarily making the Apartment available for tourist or leisure purposes.

1.4. BillBerry Apartments informs Customers that pursuant to art. 38 point 12 of the Act of May 30, 2014. on consumer rights, in the case of a contract for the provision of accommodation services other than for residential purposes, the consumer is not entitled to withdraw from a distance or off-premises contract, which the Customer hereby acknowledges.

  1. Definitions

2.1. Apartment – a residential property offered by BillBerry Apartments, described in detail on the website www.billberry-apartments.pl or other intermediary portals, which is the subject of the reservation;

2.2. BillBerry Apartments – BillBerry Capital Group Sp. z o. o. with its registered office in Gdańsk (80-017), at ul. Trakt Święty Wojciecha 149, entered into the Register of Entrepreneurs of the National Court Register by the District Court Gdańsk-Północ in Gdańsk, VII Commercial Division of the National Court Register under the number: 0000940991, NIP: 5842767963, REGON: 369471268, with share capital: PLN 100,000.00, in fully paid;

2.3. Customer - a guest, a natural person (over 18 years of age) or a legal person who is a party to a short-term apartment rental agreement or expresses a willingness to use the services of BillBerry Apartments by booking a selected apartment;

2.4. Regulations - these Short-Term Rental Regulations;

2.5. Resident - a person appointed by BillBerry Apartments, who is authorized to deliver and collect the Apartment from the Customer, as well as to other activities specified in these Regulations;

2.6. Website – website www.billberry-apartments.pl or other website through which the possibility of making a Reservation is made available;

2.7. Reservation - the act of choosing the Apartment and the date of stay in the Apartment by the Customer and possibly other conditions of such stay made via the Website or by phone, through which the contract between BillBerry Apartments and the Customer for the rental of the Premises is concluded in accordance with the offer and on the terms set out in the Regulations.

  1. Reservation

3.1. Making a reservation is tantamount to accepting the content of the Regulations.

3.2. The Apartment can be booked in the following way:

  • By using the booking form provided by BillBerry Apartments via the website www.billberry-apartments.pl;
  • Via the helpline at: + 48 572-090-800 available only from Monday to Friday, 9:00-17:00;
  • To the e-mail address: rezerwacje@billberry-apartments.pl;
  • Using an intermediary portal cooperating with BillBerry Apartments.

3.3. During the booking process, the Customer is obliged to provide the following information:

  • Date of stay (check-in and check-out dates);
  • Selected Apartment;
  • Contact details (name, surname, telephone number, address, e-mail address);
  • The number of people in the Apartment, with the proviso that it may not exceed the permissible number of people indicated in the offer;
  • Estimated time of arrival;
  • Additional services;

3.4. Confirmation of the Booking by BillBerry Apartments takes place by delivering to the e-mail address provided by the Customer during the booking process, a message with information about the confirmation of the booking, summarizing the offer and specifying the total price of the service.

3.5. The stay of a child up to 4 years old who sleeps with a guardian or in their own private bed, for which no additional bedding is required, is free of charge. One child up to 4 years of age can stay for each guardian free of charge. At the time of booking, please provide the total number of people along with the age of the children and separately children whose stay is treated as free of charge (information should be added in the REMARKS tab). The maximum number of people in the room, including children, cannot exceed the maximum number of people allowed in the Apartment.

  1. Reservation Fee

4.1. The Customer making a Reservation via the Website is obliged to pay the total price of the service indicated in the Reservation summary, following the instructions contained in the booking panel.

4.2. In the case of a telephone Booking, in order to confirm it, the Customer is obliged to immediately pay the booking fee by bank transfer to the account indicated in the booking confirmation (in the amount of at least 30% of the service price). Failure to credit the above-mentioned payment on the next day by 15:00, entitles BillBerry Apartments to cancel the Reservation. The remaining amount of the fee for the service should be paid no later than 7 days before the date of the agreed day of commencement of stay in the Apartment. However, if there are less than 7 days left until the date of making the telephone reservation, the total value of the reservation must be paid at the time of making the reservation via bank transfer. It should be made by providing the name of the Apartment, the date of stay and the booking number in the payment title.   1. Change / Cancellation

5.1. Changing the Reservation is only possible if the Apartment has not already been booked on another date selected by the Customer. If the price of the service in the new date is higher than the previous one, the Customer is obliged to cover the difference in the price of the service. If the price of the service in the new date is lower than the previous one, BillBerry Apartments will refund the difference in the price of the service to the Customer within 14 days. It is possible to change the Reservation up to 7 days before the day of commencement of stay in the Apartment.

5.2. Cancellation of the Reservation by the Customer is possible up to 7 days before the planned date of commencement of stay in the Apartment. In this case, the booking fee paid by the Customer, less the fee charged by the payment operator (approx. 1.5% of the payment) is returned within 7 working days to the indicated bank account number. If the Booking is canceled after the indicated date, the booking fee will not be refunded.

5.3. Apart from the situation indicated in point 5.2 above, the Reservation may be canceled by the Customer if, for reasons beyond the control of the Customer, it is not possible to deliver the Apartment to the Customer within the time limit resulting from the Reservation in the intended condition - such as a failure in the Apartment, error in the reservation system or withdrawal of the Apartment from the offer. Then the Customer will be offered an Apartment of a comparable standard or the possibility of resigning from the Booking free of charge.

5.4. In the event of unforeseeable circumstances in the Apartment booked by the Customer, the consequences of which cannot be removed, BillBerry Apartments will offer the Customer a replacement Apartment of a similar standard. In this case, the Customer has the right to withdraw from the Reservation with the obligation to return all amounts paid by the Customer to the indicated bank account.

5.5. In the case of payment for the Reservation in whole or in part by vouchers or gift vouchers, in the event of cancellation of the Booking by the Customer or for reasons attributable to the Customer, it is not possible to return the value of the voucher or gift voucher.

  1. Check-in and check-out

6.1. The hotel day starts at 16:00 on the day of the stay in accordance with the Reservation (check-in) and ends at 11:00 on the day of the stay in accordance with the Reservation (check-out).

6.2. Check-in is self-service based on the instructions sent on the day of arrival to the phone number indicated when booking.

6.3. On the day of check-out, the Customer is obliged to leave the keys to the Apartment in the appropriate place, in accordance with the instructions sent on the day of check-in. The same rule applies to pilots and parking cards (if issued to guests). Failure to comply with this rule may result in charging the Customer up to the amount of costs incurred by BillBerry Apartments.

6.4. BillBerry Apartments reserves the right to collect a deposit of PLN 500 as security for the stay. The deposit is returned on the day of departure, in full amount, provided that no damage has been done to the apartment. The amount of the deposit may vary depending on the nature of the stay (a higher amount may be charged in the case of special events and stays on holidays) and the number of people. The deduction of BillBerry Apartments' receivables from the deposit does not exclude the pursuit of claims for damages suffered and potential income not achieved, the value of which exceeds the collected deposit.

6.5. BillBerry Apartments reserves the right to refuse to hand over the Apartment and cancel the Reservation to persons under the influence of alcohol, drugs, aggressive behavior and posing a direct threat to other persons and property. BillBerry Apartments may refuse to provide the Apartment to Customers who grossly violated the Regulations during their previous stay, including in the event of unpaid payments.

6.6. Before checking out, BillBerry Apartments reserves the right to check the technical condition of the Apartment. In the event of damage caused during the Customer's stay, the Customer is obliged to cover the repair costs in full, no later than on the day of check-out.

6.7. Early departure for reasons not attributable to BillBerry Apartments does not entitle to claim reimbursement for unused benefits.

  1. Client's obligations during stay in the apartment

7.1. The customer undertakes to use the apartment only for tourist or leisure purposes and may not sublet the apartment or use it free of charge to any third parties.

7.2. Immediately after check-in, the Customer should report any irregularities found in the Apartment, otherwise it may result in charging the Customer with the costs of repairing the damage found.

7.3. Quiet time is valid in the Apartment from 22:00 to 6:00. In the event of non-compliance with generally accepted norms of social coexistence, disturbing the peace of the neighbors, BillBerry Apartments reserves the right to immediately terminate the Booking with immediate effect, without the obligation to refund the unused time of stay.

7.4. It is forbidden to organize any kind of events in the Apartments. In the event of breaking the ban on organizing events, the Landlord reserves the right to immediately terminate the Reservation, without the obligation to refund the costs for the unused time of stay.

7.5. It is strictly forbidden to smoke tobacco, stimulants and e-cigarettes in the Apartment. In the event of non-compliance with the prohibition, BillBerry Apartments may charge an additional fee of PLN 500, which does not limit the right of BillBerry Apartments to claim compensation on general terms.

7.6. Customers are obliged to properly secure the Apartment, which is understood as carefully closing the entrance door and windows each time they leave it, and carefully storing the keys without access to them by unauthorized persons. It is forbidden to remove items from the Apartment. Customers are obliged to take care of the rented Apartment, including: turning off unnecessary lighting, turning off the water, not breaking the information hanging on the door of the Apartment.

7.7. The Customer is obliged to maintain and return the Apartment intact beyond the wear and tear resulting from normal use. On the day of departure, Guests of the Apartment are obliged to throw away their garbage in the containers located outside the building.

7.8. BillBerry Apartments or another designated person has the right to enter the Apartment in order to remove a failure or in the event of reasonable suspicion that the Customer violates the provisions of the Regulations.

7.9. The customer is obliged to pay special attention to the proper handling of batteries, fittings and electrical devices. Due to fire protection regulations, the Customer may not use any electrically powered devices that are not part of the equipment, with the exception of: a computer, a razor, a hair dryer, a phone charger.

7.10. BillBerry Apartments is not responsible for items left in the apartment. Any return of found items is possible only at the Customer's expense.

7.11. The customer is responsible for the actions and omissions of all guests staying with him in the apartment as for his own.

  1. Additional Services

8.1. The customer has the option of ordering additional services according to the following price list:

  • Stay of a pet - PLN 40/day/animal, only in selected Apartments;
  • The service of changing bed linen and towels - the price is set individually depending on the number of guests. The date and time of the service must be agreed at least one day in advance and confirmed by BillBerry Apartments;
  • Apartment cleaning service - PLN 200, one-time service;
  • Screens and beach chairs - free of charge, available as far as possible;

8.2. Additional services are provided after receiving confirmation of payment to the account of BillBerry Capital Group Sp. z o.o.: 91 1050 1298 1000 0090 8309 3147.

  1. Stay with pets

9.1. Pets are allowed only in selected Apartments. The staff of the Apartment has the right to refuse to make it available to Customers who have taken a pet with them without prior agreement.

9.2. A booklet confirming current vaccinations of animals is required. A bedding/kennel cage, etc. should be taken for all pets. It is forbidden for animals to stay on sofas, sofas, armchairs, etc.

9.3. An additional fee is charged for the stay of animals, in accordance with the price list of Additional Services and payable before arrival to the account of BillBerry Capital Group Sp. z o.o.: 91 1050 1298 1000 0090 8309 3147. In the case of more than one animal, BillBerry Apartments reserves the right to collect an additional deposit of PLN 1,000.

9.4. The owner is obliged to clean up after his animal.

9.5. The customer is fully responsible for the stay of the animal and any damage caused by it, in particular for cleaning carpets, armchairs, sofas from hair or removing unpleasant odors.

9.6. If, on the day of check-out, the condition of the Apartment makes it impossible for other people to stay, a fine in the amount of twice the price per day of the Apartment will be imposed on the Customer.

  1. Liability

10.1. BillBerry Apartments is not responsible for any inconvenience caused during your stay related to:

  • Construction or finishing works carried out on the premises where the Apartment is located and around it;
  • Interruption of media supply for reasons beyond the control of BillBerry Apartments;
  • Noise from neighboring properties.

10.2. BillBerry Apartments is not responsible for the loss or damage of the vehicle left by the Customer in the garage belonging to the Apartment or on external parking spaces.

10.3. The customer is responsible for any damage caused by his actions resulting from the use of paid or free attractions that are located on the premises where the customer rents the apartment, such as sauna, tennis courts, fitness rooms, playgrounds, etc.

10.4. The customer is obliged to immediately report any damage caused by him during his stay and immediately cover their equivalent. The customer is also fully responsible for damages caused by persons staying in the Apartment with his consent or knowledge. If the damage prevents further rental, the Customer is additionally financially responsible for each day excluded from the rental, in the amount of twice the current price for a given Apartment.

10.5. In the event of contamination of the apartment with vomit, the Customer is obliged, at the request of BillBerry Apartments, to cover the costs of cleaning carpets and other contaminated materials - in the amount of PLN 1,500.

10.6. Smoking cigarettes, other tobacco products, stimulants in the Apartments and in the staircases and in the garage, as well as the use of candles is prohibited. Violation of the ban entitles BillBerry Apartments to impose a contractual penalty of PLN 500.

10.7. If the Apartment is not returned after the reservation is completed, the Customer is obliged to pay twice the current price for a given Apartment, specified on the website www.billberry-apartments.pl, for each day after the date of completion of the reservation.

10.8. During check-out, the Customer is obliged to return all shared keys or entry cards and remote controls. In the event of failure to return the goods, the Customer shall pay a fee of PLN 500 (keys, entry card) and PLN 500 (remote control) respectively.

10.9. The apartment cannot accommodate more people than the number stated during the booking. If the number of people is greater, the Customer will be charged an additional fee of PLN 200 for each additional person for each day.

10.10. In the event that the damage exceeds the value of the penalty or additional fee reserved in these Regulations, BillBerry Apartments is entitled to claim compensation on general terms.

10.11. In the event of an unjustified call by an employee of BillBerry Apartments to the rented apartment, an additional fee of PLN 300 will be charged, which will be charged by an authorized employee of BillBerry Apartments on the day of arrival.

  1. Complaints

11.1. In the event of irregularities, the Lessee has the right to file a complaint within 14 days of their occurrence. Complaints should be sent in writing to the address of the BillBerry Apartments headquarters or by e-mail to reklamacje@billberry-apartments.pl.

11.2. Consideration of the complaint takes place within 30 working days of its receipt. The Customer will be immediately notified of its consideration by registered mail or electronically to the appropriate address indicated in the complaint.

11.3. For pursuing claims in court, the competent court for the seat of BillBerry Apartments is the District Court Gdańsk-Północ in Gdańsk, and the defendant should be BillBerry Capital Group Sp. z o. o. based in Gdańsk. The consumer also has the right to ask for help from the Municipal or Poviat Consumer Ombudsman.

12.3. The correspondence address is the registered office of BillBerry Apartments, indicated in point 12.1. of the Regulations.

  1. Privacy Policy

13.1. The administrator of personal data is BillBerry Capital Group Sp. z o. o. with its registered office in Gdańsk (80-017), at ul. Route of St. Wojciecha 149, entered into the Register of Entrepreneurs of the National Court Register by the District Court Gdańsk-Północ in Gdańsk, 7th Commercial Division of the National Court Register under the number: 0000940991, NIP: 5842767963, REGON: 369471268.

13.2. Personal data is processed in order to implement the Reservation and the Regulations. Providing data is voluntary, but necessary to use the services of BillBerry Apartments. Personal data will be processed until the expiry of the limitation period for claims arising from the booking or performance of the service, and in the case of data collected on the basis of consent, until its withdrawal.

13.3. The basis for the processing of personal data is:

  • Art. 6 sec. 1 lit. b RODO (GDPR) - the necessity of their processing in order to implement and perform the contract;
  • Art. 6 sec. 1 lit. f RODO (GDPR) - the legitimate interest of the administrator consisting in handling correspondence and marketing activities.

13.4. Customers have the right to access data and the right to request rectification, deletion or limitation of their processing. The customer has the right to object to the processing of personal data.

13.5. To the extent that the basis for the processing of personal data is consent, the Customer has the right to withdraw consent. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. The data may be subject to profiling within the scope of the consent given.

13.6. Personal data may be transferred to companies providing accounting services.

13.7. In all matters regarding the processing of personal data and the exercise of rights related to data processing, you can contact us by post to the address of the Administrator's registered office, indicated in point 12.1. or by e-mail to the following e-mail address: daneosobowe@billberry-apartments.pl. The customer has the right to lodge a complaint with the supervisory body dealing with the protection of personal data (the President of the Office for Personal Data Protection).
